I know I can't re-sell it with the source code, but I am assuming if I am paying extra for an OEM license, I can sell the executable version, right?
only if you are selling the computer or a major piece of that computer's hardware, such as the motherboard or hard drive, along with it.
Not unless that is included in the terms oem software licenseof the license.
If, for example, you make computers, and you buy an OEM (Original Equipment Manufacturer) license for Windows Vista, you can sell your computers with Vista installed, because your OEM license will call for you to pay MS such-and-such a license fee for every computer that you sell. If you sell a copy to a froem software licenseiend for him to install on his own computer then you've broken the law.
If you buy an OEM copy of Vista at a computer show or from eBay, it was illegal for you to even buy it, let alone sell it, because OEM version can ONLY be sold with the manufacturers equipment that it's licensed for.
